These Terms of Service (“Terms”) govern your use of Aiery, an AI health-coaching service operated by ConditionCreative (“we,” “us”). By signing up for or using Aiery, you agree to these Terms.
1. What Aiery is
Aiery is a personal AI coach you reach by calling or texting a phone number. It provides general wellness, nutrition, and lifestyle coaching and remembers your conversations to personalize future ones.
Aiery is not medical care. It does not diagnose conditions, prescribe treatment, or replace a doctor. For medical concerns, consult a qualified clinician; in an emergency, call your local emergency number.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use Aiery. By using the service you confirm the information you provide is accurate and that the phone number you provide is yours.
3. Messaging & consent
By opting in on our signup form, you consent to receive calls and SMS messages from Aiery at the number you provide. Message frequency varies and message and data rates may apply. You can opt out of texts at any time by replying STOP, or reply HELP for help. See our Privacy Policy for how we handle your data.
4. Plans, billing & usage
- You can start free with a limited amount of voice minutes and texting, with no credit card required.
- Paid plans are billed monthly through our payment processor (Stripe). Voice usage may draw from a monthly allowance, with overage charged per minute as shown at signup.
- You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
5. Acceptable use
You agree not to use Aiery to harass others, to seek emergency or crisis services, for unlawful purposes, or in any way that disrupts or abuses the service. We may suspend or terminate accounts that violate these Terms.
6. Your content & memory
You retain ownership of the information you share. You grant us permission to store and process your conversations to provide and improve the service. You can ask us to delete your data or have Aiery forget specific details at any time, as described in our Privacy Policy.
7. Disclaimers
Aiery is provided “as is.” Coaching content is generated by AI and may be inaccurate or incomplete. You are responsible for your own health decisions and should use judgment and professional advice. To the fullest extent permitted by law, we disclaim all warranties.
8. Limitation of liability
To the fullest extent permitted by law, ConditionCreative will not be liable for any indirect, incidental, or consequential damages arising from your use of Aiery. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.
9. Changes
We may update these Terms from time to time. Continued use after changes means you accept the updated Terms. Material changes will be reflected by the “Last updated” date above.
